Clarification on the false and misleading statements regarding the court order on the dealer margins –
පසුගිය දිනයේ ජනාධිපති අනුර කුමාර දිසානායක මහතාගේ රජයේ නියෝජිතයන්, විවිද දේශපාලන නියෝජිතයන්, සමාජ මාධ්‍ය නියෝජිතයන් සහ මාධ්‍ය මගින් පැවති ජනාධිපති රනිල් වික්‍රමසිංහ මහතාගේ රජය විසින් අධිකරණය මගින් ලබා දී තිබු නියෝග ක්‍රියාත්මක නොකර බෙදුම්කරුවන්ට වාසි සහගත ලෙස කටයුතු කල බව සහ අය විය යුතු මුදල් අය නොකර ගත් බව අසත්‍ය ලෙස ප්‍රකාශ කර සිටින ලැබුණි.
පසුගිය කාලයේ ලාභංශ ප්‍රතිශත පිලිබඳ තීරණ ක්‍රියාත්මක කිරීමේදී, ඛණිජ තෙල් බෙදුම්කරුවන් පසුගිය 2022 වසරේ මාර්තු මස මහාධිකරණයේ සහ 2023 වසරේ අභියාචනාධිකරණය මගින් එම තීරණ ක්‍රියාත්මක කිරීම වළක්වාලමින් ලංකා ඛණිජ තෙල් සංස්ථාවට එරෙහිව තහනම් නියෝග දෙකක් ගනු ලැබුණි.
එම තහනම ඉවත් කරමින් අභියාචනාධිකරණය මගින් සංස්ථාවේ තීරණය ක්‍රියාත්මක කරන ලෙස 2024 වසරේ අගෝස්තු 30වන සිකුරාදා නියෝගයක් නිකුත් කරනු ලැබුණි. එම නියෝගය විදුලිබල සහ බලශක්ති අමාත්‍යංශය වෙත සැප්තැම්බර් මස 2 වන සඳුදා ලබා දෙන ලැබුණි.
එම නියෝගය අනුව අමාත්‍යංශයේ ලේකම්වරයා විසින් නීතිපති දෙපාර්තමේන්තුවට එම නියෝගය පිළිබඳව උපදෙස් ලබා දෙන ලෙසත් ඛණිජ තෙල් සංස්ථාවට එම නියෝගය අනුව කටයුතු කරන ලෙස දැන්වත් කරනු ලැබුණි.
ඒ අනුව කටයුතු කිරීමේදී ඛණිජ තෙල් බෙදුම්කරුවන් නැවත එම නියෝගයට අභියාචනයක් සැප්තැම්බර් මස දෙවන සතියේ ශ්‍රේෂ්ඨධිකරණයට ඉදිරිපත් කරන ලදි. එහි පළමු නඩු විභාගය සැප්තැම්බර් මස 18 වන දින සිදු විය.
සැප්තැම්බර් මස 23 වන දිනෙන් පසු පැවති රජය වෙනස් වීමත් සමග ශ්‍රේෂ්ඨධිකරණය ලබා දුන් නව තීරණය, නීතිපතිවරයාගේ උපදෙස් හෝ ඛණිජ තෙල් සංස්ථාව ක්‍රියාත්මක කල ක්‍රමවේදය පිළිබඳව මා හට අවබෝධයක් නොමැත.

Clarification on the false and misleading statements regarding the court order on the dealer margins –
Some individuals of the President President Anura Kunara Dissanayake Government, political activist, social media activist and main stream media made false and misleading allegations yesterday, that the previous govt of President Ranil Wickremesinghe did not act on a court order on the dealer margins against the petroleum dealers in 2023 and failed to recover money due to CPC from them.
The petroleum dealers association obtained court orders in the high court in 2022 & court of appeal in 2023 preventing the previous govt from implementing a tariff formula approved by the CPC.
The court of appeal gave an order revoking the previous order on Friday the 30th of August 2024 and was received by the Ministry on Monday the 2nd of September 2024.
The secratary to the Ministry of Power & Energy took steps to immediately, to write to the Attorney Generals Department inquiring directions and their opinion on the order to implement it & instructed CPC to take appropriate steps to implement the order.
The petroleum dealers association appealed again in the Supreme Court in the second week of September 2024 and the first hearing was held on the 18th of September.
I don’t know if there was any order that was granted by the Supreme Court or whether the Ministry received the opinion from the attorney generals office or what the opinion was since the 23rd of September 2024.
